Carol Ann Brown, a minor, and her mother, Minnie Lee Brown, sued defendants George Pepperdine Foundation and Oliver & Williams Company for damages resulting from personal injuries received by the minor. The jury returned a verdict for the defendants, and the court granted plaintiffs motion for a new trial. George Pepperdine Foundation alone appealed from the order granting the new trial.
