In these consolidated appeals, Defendant-Appellant Larry M. Miller appeals from two separate rulings by the circuit court: 1) an order dated April 22, 1993, denying his motion to reconsider the courts March 8, 1993 ruling granting the prosecutions motion to revoke an earlier sentence of probation and resentencing him to probation with a special condition of one year in jail; and 2) an order dated April 15, 1994, revoking his March 8, 1993 sentence and resentencing him to ten years imprisonment. Miller essentially raises two issues: 1) whether the circuit court abused its discretion under Hawaii Revised Statutes (HRS) chapter 706 (1985, Supp. 1992 & Comp. 1993) by refusing to credit the time he served in prison as a condition of prior probationary sentences toward the year of imprisonment imposed as a condition of his March 8, 1993 sentence; and 2) whether the circuit court erred in issuing an ex parte bench warrant for his arrest, revoking his probation, and resentencing him to ten years imprisonment.
